Personal Data Protection - GDPR

Personal data 

Personal data includes data and information about a specific (identified) or detectable (identifiable) natural person. This includes, for instance, data such as name, surname, address, identification number, telephone number and email address.

Information that cannot be assigned to a specific (identified) or detectable (identifiable) natural person, such as statistical data, is not deemed to be personal data.

 

Data subject 

The data subject is an identified or identifiable natural person who visits or uses the SDS website www.sds.sk.

 

Applicable data protection laws and obligation to maintain data confidentiality

SDS processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the  processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter also referred to as the "GDPR"), in accordance with Act No. 18/2018 Coll. on Personal Data Protection and amending and supplementing certain Acts (hereinafter also referred to as the "Personal Data Protection Act"), with regard to the relevant legal regulations of the Slovak Republic, especially in accordance with Act No. 324/2011 Coll. on Postal Services and on amendments and supplements to certain acts as amended (hereinafter referred to as the "PS Act"), which regulates the conditions for the provision of postal services and postal payment transaction, as well as the rights and obligations of postal service providers, i.e. including SDS company. Pursuant to the PS Act, when providing postal services or postal payment transactions, SDS is entitled to request and record personal data about the consignor and consignee and their representatives in the scope of name, surname, degree, address, identity document information, bank connection for postal payment transactions and process and store them in information systems to the extent necessary for the provision of postal services or postal payment transactions, unless the Personal Data Protection Act provides otherwise. SDS ensures the protection of information about the provided postal services and postal payment transaction and the protection of personal data against their unauthorized access or publication and against their misuse.

SDS is obliged to comply with the provisions on postal secrecy. Any and all employees and authorized persons of SDS are obliged to maintain the confidentiality of information and data subject to postal secrecy and the confidentiality of personal data.

 

Security of information systems

Through technical and organizational security measures, SDS focuses on maximum protection of personal data against their loss or misuse.

Personal data is processed only in information systems that are protected by the necessary security measures.

SDS will modify and adapt technical and security measures for the protection of personal data to the required extent and appropriately to technological developments.

 

Rights of data subjects 

SDS respects the fundamental rights and freedoms of the data subjects. The GDPR increases the data subject's right to privacy. According to this regulation, data subjects have the right to:

a) be informed about the processing of their personal data and have access to it (the right to be informed and the right to access data pursuant to Article 15 GDPR);

b) to correct incorrect personal data (right to rectification pursuant to Article 16 GDPR);

c) to erase their personal data (right to erasure pursuant to Article 17 GDPR);

d) to restrict processing (right to restriction of processing pursuant to Article 18 GDPR);

e) to obtain your personal data (right to data portability pursuant to Article 20 GDPR);

f) to object to the processing of data for reasons related to their specific situation, which is carried out on the basis of legitimate interests or the implementation of an important task in the public interest (the right to object pursuant to Article 21 of the GDPR, provided that the necessary legal requirements are met.

 

 

 

Withdrawal of consent

In the event that your consent to the processing of your personal data was required, please note that you have the right to withdraw this consent at any time in the future, regardless of the legality of the processing carried out on the basis of consent prior to the withdrawal of this consent.

Exercising your right

If you wish to exercise your rights as a data subject or withdraw explicit consent, send a message to the responsible person at SDS at info@sds.sk and indicate which right you want to exercise, so that SDS can take the necessary further steps to respect your right.

 

The right to object

If you are of the opinion that your rights have been violated in the processing of personal data, you have the right to file objections with the Office for Personal Data Protection of the Slovak Republic.

 

Collection, processing and use of personal data

1. Every time the user visits the SDS website www.sds.sk, the data is saved in a log file. The following specific data will be temporarily stored: a) IP number of the computer from which the request came; b) domain name; c) date and time of access; d) HTTP status code; e) visited pages; f) operating system and its version; g) browser and its version and h) screen resolution.

2. In order to use the SDS website www.sds.sk, it may be necessary for the SDS servers to insert the so-called cookies (small text files placed on the computer by the visited website). These cookies are used by the technical administrators of the website. Every visitor can set their browser to reject cookies. Any and all visitors have the right to refuse cookies. Unless the user expresses consent, no cookies are stored on the visitor's computer. In this case, data stored in cookies will not be transferred to SDS. The functionality of specific parts of the website may be unavailable when cookies are disabled.

3. SDS distinguishes between open and closed areas of use of the SDS website www.sds.sk. The closed area is necessary for the fulfillment of contracts between SDS and its partners. Access is only possible using a username and password.

Other features of the open area include a contact form and "Track & Trace". The data provided in the scope required in the contact form, such as name, surname, street, house number, zip code, city, etc., are necessary to process your request. Your personal data will not be transferred, sold or otherwise transferred to third parties.

4. The data from the log file is analyzed anonymously for statistical purposes. Statistical reports are used to assess the use of the SDS website www.sds.sk. In particular, the order in which the pages are visited and the way to navigate between them. This is in order for SDS to have an overview of the usability of the website and how it can be enhanced.

 

The website uses Google Analytics, which is a web service from Google Inc. (hereinafter also referred to as "Google"). Google uses cookies, on the basis of which it is possible to analyze your use of the SDS website. This information about your use of the website, created by the cookie file (including your IP address), is sent to the Google server and stored there. Google will use this information to analyze your use of the SDS website, to compile reports on the activities on the SDS website for the administrators of this website and to perform other services that are related to the use of the website and the Internet.

 

Further to this, Google transfers this information to third parties if this is required by law or if a third party processes this data on Google's behalf. Google will not assign your IP address to other Google data under any circumstances. You can avoid storing cookies by adjusting the relevant setting in your browser; however, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent. By using this website, you agree that Google will process the collected data about you in the manner described above and for the purposes described above.

 

Sending news

SDS may send newsletters, unless it receives a withdrawal of consent, to those customers who previously agreed to send newsletters to the specified email address. The database for sending news includes first name, last name, email address and time of given consent or withdrawal of consent. Data subjects have the right to withdraw their consent at any time by sending a message to info@sds.sk or by contacting the SDS customer center. The database for sending news is used only for sending news.
